Terms of Service

1. License Grant

Subject to your compliance with these Terms, Water Mill Games LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use our Apps on Apple-branded devices that you own or control, solely for your personal, non-commercial entertainment purposes.

2. Restrictions

You agree that you will not:

1. Copy, modify, adapt, translate, reverse-engineer, decompile, or disassemble any App or create derivative works based on it.
2. Remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) contained within any App.
3. Use any App for any commercial purpose or for any public display, performance, or distribution.
4. Use any automated means (bots, scripts, cheats, hacks) to interact with any App.
5. Use any App in any manner that could damage, disable, or impair it.
6. Violate any applicable local, state, national, or international law or regulation.

3. User Accounts (Word Bridge)

Word Bridge offers optional account-based features including global leaderboards and group play. The following terms apply if you choose to create an account:

1. Accounts are created using Sign In with Apple. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account.
2. You may only create one account. Creating multiple accounts to gain an unfair advantage on leaderboards is prohibited.
3. You are responsible for the screen name you choose. Screen names must not be offensive, vulgar, defamatory, or in violation of any third-party rights. We reserve the right to remove or change any screen name we deem inappropriate, at our sole discretion, without notice.
4. You may request deletion of your account and associated data at any time by contacting us at info@water-mill-games.com. We will process deletion requests within 30 days.
5. You can play Word Bridge without an account. Account creation is only required to access leaderboard and group features.

4. Leaderboards and Fair Play (Word Bridge)

Word Bridge features global and group leaderboards. By participating, you agree that:

1. All scores submitted to leaderboards must be achieved through legitimate gameplay. Exploiting bugs, using cheats, or manipulating scores by any means is prohibited.
2. You will not attempt to manipulate group leaderboards by creating fake groups or inviting unauthorized accounts.
3. We reserve the right to remove any score or disqualify any account we determine, in our sole discretion, to have violated these fair play rules.
4. Leaderboard data is stored on our servers and may be reset or modified at our discretion, including at the end of weekly leaderboard cycles.

5. In-App Purchases

1. Our Apps may offer optional in-app purchases. All purchases are processed by Apple through the App Store and are subject to Apple's Terms and Conditions.
2. All sales are final. Refunds are handled solely by Apple in accordance with their refund policies. Water Mill Games LLC does not process refunds directly.
3. You are responsible for any charges incurred through your Apple ID, including purchases made by minors using your account.
4. Prices are subject to change at any time in accordance with App Store policies.
5. For Word Bridge, purchase entitlements are verified through RevenueCat, Inc. Leaderboard access is tied to your Apple ID and can be restored on any device using the Restore Purchases feature.

6. Intellectual Property

1. All content in our Apps — including graphics, artwork, game design, sounds, music, text, and software — is owned by or licensed to Water Mill Games LLC and is protected by copyright, trademark, and other intellectual property laws.
2. "Water Mill Games," "Word Drop," and "Word Bridge" are trademarks of Water Mill Games LLC. You may not use these marks without our prior written consent.
3. Nothing in these Terms grants you any ownership rights in any App or its content.

7. Privacy

Your use of our Apps is governed by our Privacy Policy, incorporated into these Terms by reference and available at: water-mill-games.com/privacy.html

8. Apple-Specific Terms

You acknowledge and agree that:

1. These Terms are between you and Water Mill Games LLC only, not with Apple Inc. Apple is not responsible for our Apps or their content.
2. Water Mill Games LLC, not Apple, is solely responsible for our Apps and for addressing any claims relating to them.
3. Apple has no obligation to provide maintenance or support for our Apps.
4. In the event of any third-party intellectual property claim, Water Mill Games LLC (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of that claim.
5. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as third-party beneficiaries.

11. Indemnification

You agree to indemnify and hold harmless Water Mill Games LLC and its members, officers, and agents from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of our Apps, your violation of these Terms, or any content you submit (including screen names).

12. Termination

We reserve the right to suspend or terminate your access to any App or your account at any time, without notice, for conduct that violates these Terms or is otherwise harmful to other users, Water Mill Games LLC, or third parties. Upon termination, your license to use the App will immediately cease. For Word Bridge accounts, we may also remove your scores and screen name from leaderboards.

13. Governing Law

1. These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law provisions.
2. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Virginia Beach, Virginia, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be reflected by updating the "Last Updated" date above. Continued use of any App constitutes acceptance of the revised Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Water Mill Games LLC regarding our Apps and supersede all prior agreements relating to them.
